Privacy policy

This Privacy Policy ("Policy") describes the "Personal Data" we collect about you, how we use it, how we share it, your rights and choices, and how you can contact us about our privacy practices. This Policy also sets out your data subject rights, including the right to object to certain uses of your Personal Data by us.

§1 Definitions

Personal Data means any information relating to an identified or identifiable natural person (hereinafter referred to as a "data subject"). Recipient is a natural or legal person, public authority, institution or other entity to which personal data are disclosed, regardless of whether it is a third party or not.

Consent is any voluntary expression of will by the data subject, in a conscious and unambiguous manner for the specific case, in the form of a statement or other clear affirmative action by which the data subject indicates that he or she agrees to the processing of his or her personal data.

A processor is a private person or a federal authority that processes personal data on behalf of the person responsible.

A data breach is a breach of security that results in the unintentional or unlawful loss, deletion, destruction or alteration, disclosure or access to unauthorized persons;

Disclosure is the transfer or provision of personal data;

§3 Personal data protection

  1. We process personal data on various occasions and for various purposes. Personal data is almost always processed when a user interacts with us or we interact with a user, e.g. when a user places an order with us. It is also important to us to be able to adapt our offers to the individual needs of the user. When a user creates a customer account, registers to use other of our services or navigates our websites, we also process behavioral data and possibly transaction data and make assumptions about the user's preferences based on them.     3.3 company handling electronic payments,
    3.4 accounting.
  4. Intermaxmedia GmbH may also make the personal data collected from the User available to entities indicated in the messages appearing on the website https://top-profis.ch. Such entities process the data on the basis of an agreement with Intermaxmedia GmbH and only in accordance with the instructions of Intermaxmedia GmbH. In order to achieve some of the described purposes, it may be necessary for us to process your personal data in countries outside Switzerland and the EU or to transfer them to these countries.
  5. The User's personal data will be processed by Intermaxmedia GmbH for as long as it is necessary to achieve the purposes indicated in § 3 sec. 2. This includes the time during which the user has consented to processing, the limitation period for claims related to the sales contract and the time required by legal regulations (e.g. tax or accounting).
  6. If the User provides personal data for the purpose of concluding a contract with Intermaxmedia GmbH, the User's provision of personal data is a condition for concluding this contract. Providing personal data in this situation is voluntary, but failure to provide this data will result in the inability to conclude a contract with Intermaxmedia GmbH.

§4 Rights of the data subject

  1. In connection with the processing of your personal data, you have the rights described below.

  2. Right to information - You have the right to request access to the personal data stored by us at any time and free of charge when we process it.
  3. Right to rectification of inaccurate data - You have the right to correct incorrect or incomplete personal data and to receive information about rectification. In such a case, we will inform the data recipients concerned about the corrections made, unless this is impossible or involves a disproportionate effort.
  4. Right to deletion - You have the right to have your personal data deleted under certain circumstances. In individual cases, in particular in the case of statutory retention obligations, the right to deletion may be excluded. In such a case, under certain conditions, the data may be blocked instead of deleted.
  5. Right to restriction of processing - You have the right to demand the restriction of the processing of your personal data.
  6. Right to data portability - You have the right to receive from us the personal data you have provided to us in a structured, common and machine-readable format.
  7. Right to object - You may object to the processing of your data at any time, in particular in connection with the processing of data in connection with direct advertising.
  8. Right to complaint - In the event of a complaint, you have the right to contact the supervisory authority of your choice.
  9. Right to withdraw consent - You have the right to withdraw your consent at any time. However, processing activities based on your consent in the past will not become unlawful as a result of your withdrawal of consent.

§5 Data security

We have taken technical and organizational security measures to protect your personal data against loss, destruction, manipulation and unauthorized access. All our employees are obliged to maintain data secrecy, i.e. confidential handling of personal data. Our security measures are constantly updated in line with technological developments.

§6 Order handling

The data of persons who placed an order on the website https://top-profis.ch are processed.

Data subject to processing: first and last name, e-mail address, telephone number, billing address, delivery address, company name and tax identification number.

The data will be processed for the purpose of order fulfillment, complaint procedure, pursuing or defending claims, as well as in connection with the fulfillment of obligations related to tax and accounting regulations.
The data is processed until the contract is fulfilled, while the data obtained for the purpose of fulfilling legal obligations is processed until they are fulfilled.

Data processed on the basis of a legitimate interest is processed until it is fulfilled or an effective objection is filed. The above processing periods may be extended by a maximum of the time necessary to establish, pursue or defend against claims. After this period, personal data will be anonymized or deleted.
Providing data is voluntary, but without providing data it will not be possible to process the order.

§7 Contact form

The data of persons who contact us via the contact form are processed.
Data that is subject to processing:  The data you have provided us with are processed, e.g. your company name, first and last name, function, e-mail address or telephone number and your request.

The data is processed to identify the person contacting you and to answer the question asked.

The data is stored until the limitation period for claims expires.
Providing data is voluntary, but necessary for verification of the User.

§8 Customer account

The data of persons who have registered their account on the https://top-profis.ch website are processed.
Data subject to processing: name and surname, username (nickname), e-mail address, telephone number, delivery address, billing address, company name and tax identification number.

The data is processed for the purpose of providing services related to maintaining and servicing an account on the website.

§10 Automated decision-making

We do not use automated decision-making or profiling.

§11 Deleting an account

Each user may decide at any time to delete their account and all data contained therein. To delete a user account, please inform the website administrator that you wish to delete the account. Just a short piece of information is enough, e.g. I am asking you to completely delete my user account. You can also provide the date of account deletion, e.g. Please delete my user account from July 31, 2027.
The User's account will be deleted on the date specified by the User, or if no specific date is provided, immediately, within 5 business days of the request for immediate account deletion.

§12 Final provisions

We reserve the right to adapt this privacy policy to always comply with current legal requirements or to implement changes to our services in the privacy policy, for example in the event of the introduction of new services.
